ORDINANCE ENTITLED "AN ORDINANCE OF THE TOWNSHIP OF DELANCO PROVIDING FOR
AND DETERMINING THE RATE OF COMPENSATION OF OFFICERS AND EMPLOYEES"

RESOLUTION 2005-156
RESOLUTION AUTHORIZING THE
TREASURER TO PAY LONGEVITY PAYMENTS TO QUALIFYING CONTRACTURAL EMPLOYEES
WHEREAS, the Township Committee of the Township of Delanco has negotiated
with the Public Works Department and has contractual agreements with said bargaining unit calling for the payment of longevity to those employees who qualify under the articles of the agreement, and;
WHEREAS, the Township Committee has deemed this request reasonable;
NOW, THEREFORE, BE IT RESOLVED by the Township Committee of the Township of Delanco that the Committee does hereby authorize the payment of longevity to those employees who qualify under contract agreements and that such longevity payments be distributed prior to December 31, 2005 if prior certification from the Chief Financial Officer verifies that such payment will not have an adverse financial impact upon the municipality in this particular year.
BE IT FURTHER RESOLVED that a copy of this Resolution be filed with the Chief Financial Officer and the Township Auditor
RESOLUTION 2005-157
AMENDING PRIOR RESOLUTION
2005-135 ON SALE OF 515 BURLINGTON AVENUE, BLOCK 1404, LOT 4, AND ADDING BLOCK
1404, LOT 6 UPON CONDITIONS
WHEREAS, the Township of Delanco is the owner of 515 Burlington Avenue, at Block Block 1404, Lot 4, more commonly known as the old municipal complex (hereinafter the Property); and
WHEREAS, the Township, by Resolution 2005-135, on September 19,
2005, authorized the sale of the Property pursuant to the Local Lands and
Buildings Law, N.J.S.A. 40A:12-1, et seq.; and
WHEREAS, the Township thereafter appointed Max
Spann Auctioneers to assist in the process of selling the Property at auction;
and
WHEREAS, Max Spann Auctioneers have made several
recommendations to the Township to assist in the marketing and sale of the
Property; and
WHEREAS,
the Township Committee of the Township of Delanco desires to amend the prior
Resolution in order to better enable the marketing and sale of the Property in
accordance with these recommendations and in the best interests of the
Township.
NOW,
THEREFORE, BE IT RESOLVED by the
Township Committee for the Township or Delanco, County of Burlington, State of
New Jersey as follows:
Section 1. Modification of Prior Resolution:
A. The terms of Resolution 2005-135 remain in effect unless otherwise modified below.
B. The Township Committee hereby authorizes the sale of Block 1404, Lot 4, and improvements thereon, by open public sale at auction to the highest bidder, which bidding process shall be by public auction in accordance with the bidding advertised by the Township Clerk. The Township Committee further hereby authorizes the sale of Block 1404, Lot 6, in association with and as a companion lot to Lot 6. Lot 6 is a 40 by 50 lot that is currently owned by the Township and included with lot 6 on the property card description.
C. Such sale is conditioned upon the following:
1. The minimum bid of $250,000 stated in the prior Resolution is repealed, and in lieu of setting an undisclosed reserve, the Township reserves the right to reject all bids.
2. That the successful bidder shall be required to deposit $10,0000 and complete closing and all payment of the remainder of the bid price to the Township within ninety (90) days.
3. That the successful bidder obtain any necessary site plan or related zoning approvals from the Delanco Township Joint Land Use Board.
4. This sale is as is and the Township makes no warranties with regard to this property or its structure(s).
5. That Lot 6 will not be developable as a separate lot from Lot 4.
C. The Auctioneer is hereby authorized and directed to publish notice of this sale in accordance with the requirements of the law, pursuant to their proposal, and is further authorized and directed to create bid documents, with the assistance and upon the review of the Township Solicitor, to effectuate the terms of this Resolution.
D. The Mayor and Township Clerk are hereby authorized to execute any and all Agreements, including an Agreement of Sale, Deed, or other closing documents required to effectuate this transaction, which forms shall be subject to the review and approval of the Township Solicitor.

DISCUSSION ITEMS:
1. PROPOSED RESOLUTION SUPPORTING THE RECYCLING ENHANCEMENT ACT
Mayor Fitzpatrick read the resolution to the public. Mayor Fitzpatrick stated that the Township Committee's desire is to pass the resolution supporting the passage of the New Jersey Recycling Enhancement Act set forth in the resolution.
Motion by Mayor Fitzpatrick, seconded by Jackie DiCarlo to adopt Resolution 2005-158 supporting the Recycling Enhancement Act.

RESOLUTION 2005-158
RESOLUTION SUPPORTING THE RECYCLING ENHANCEMENT ACT
Whereas, recycling saves America's natural
resources for generations to come while significantly reducing solid waste
disposal costs and preserving landfill space, and
Whereas, the State of New Jersey's municipal
recycling rate has dropped from 45% to 33% over the last nine years, and
Whereas, the New Jersey State Recycling Tax, which
provided a funding source for municipal recycling grants, county planning and
educational outreach effort expired on Dec.31, 1996, and
Whereas, this significant source of funding is no
longer available to municipalities and counties, and
Whereas, the passage of the proposed New Jersey
Recycling Enhancement Act (S2615/A4075) would restore funding critical to the
continued success and growth of recycling programs in New Jersey, and
Whereas, the tax reinstituted under the New Jersey
Recycling Enhancement Act would be collected from all generators of solid waste
in New Jersey and also would be assessed on all solid waste imported into the
state, and would not exceed $3.00 per ton of solid waste generated, and
Whereas, 60 percent of the total raised by the tax would be
appropriated to municipalities in the form of annual recycling grants
which would be significantly higher than the amounts awarded to municipalities
prior to the expiration of the recycling tax in 19%, and
Whereas, municipal recycling grants arc essential to ensure the
sustainability of mandatory municipal recycling programs,
Now, therefore, Be
it resolved, that the Township
Committee of the Township of Delanco, County of Burlington, supports the
passage of the New Jersey Recycling Enhancement Act which shall include the conditions
set forth in this resolution, and
Be it Further Resolved, that the Township
Committee of the Township of Delanco, County of Burlington, urges both houses
of The New Jersey Legislature to pass the Recycling Enhancement Act and further
urges all New Jersey legislators to offer their support for such legislation.

Mayor Fitzpatrick reported that she received a letter from Kevin Tuno, Burlington County Emergency Management Coordinator thanking Delanco Township for allowing them to use their facility for their meeting.
MEETING OPEN TO THE PUBLIC
Mayor Fitzpatrick opened the meeting to the public.
1. Frank Taylor, 413 Richards Avenue, expressed his concern that Delanco Township purchased the Lippincott building on Burlington Avenue. Mayor Fitzpatrick stated that the purpose for purchasing the building was to demolish it and put additional parking to eliminate congestion on that corner. Mr. Taylor complained about the condition of Richards Avenue and asked if the Township planned on fixing that street.
2. Steve Schofield, 400 Burlington Avenue, commented on Delanco Township's rental registration fees. A discussion ensued regarding the fees.
3. John Rahenkamp, 1700 Second Street, suggested that the rental fee collection be done in an incentive laden system rather than a punitive system. A discussion ensued regarding the parking problem on Burlington Avenue. Mr. Rahenkamp proposed a COAH house for a Washington Street location where a house is now located, and asked the Township Committee for their approval. Mayor Fitzpatrick stated that the Township Committee would vote on it and tabled it until the next Township Committee meeting.
4. Ralph McCullough, 208 Buttonwood Street, expressed his concern about the parking problem on Burlington Avenue.
Mayor Fitzpatrick expressed her opinion that she would not endorse the property on Washington Street for a COAH home because she felt that the area was over saturated with COAH rentals.
MEETING CLOSED TO THE PUBLIC
Since there were no further comments or questions, Mayor Fitzpatrick closed the meeting to the public.
Mayor Fitzpatrick introduced Pam Casparro, the representative from the Delanco Township PTO. Ms. Casparo reported on the Fall fund drives, and the upcoming December events. Committeewoman Joan Hinkle asked about the Target fund.

● Leaves Department is behind on leave pickup due to the lateness of the leaves dropping Leaves can be put in the street but have to be at least ten feet from a storm drain Problem with sticks mixed with the leaves Time lost due to amount of Holidays
Mayor Fitzpatrick suggested doing a schedule by streets for Township leaf pickup. A suggestion was made to post a leaf pickup schedule on the Township website.

Mrs. Lohr stated that she had nothing to report but wished everyone a Happy Thanksgiving.
